DUCKS KOREA Terms of Service
Article 1: General Provisions
These terms and conditions aim to define the rights, obligations, and responsibilities of users and other necessary matters in detail when using the "DUCKS KOREA service" (hereinafter referred to as "DUCKS KOREA") operated by DUCKS KOREA Co., Ltd. (hereinafter referred to as "the Company").
Article 2: Definitions
"DUCKS KOREA" refers to the virtual business location created by the Company to provide DUCKS KOREA services to users.
"User" refers to members who sign up for DUCKS KOREA according to these terms and receive the services provided by DUCKS KOREA.
"Member" means a person who applies for membership, agrees to these terms, and is issued a member ID by the Company to use the services operated by the Company. It also refers to a registered user who provides personal information to DUCKS KOREA and can continuously use the services provided by DUCKS KOREA.
"Non-member" refers to a person who uses the services provided by DUCKS KOREA without signing up for membership.
"Purchase Agency" refers to the service where DUCKS KOREA is entrusted by members to purchase and pay for goods on their behalf. This is a paid service that excludes other forms of profit or transaction responsibility arising from the purchase transaction, beyond the purchase agency fee and responsibility. The cost for purchase agency includes the total amount required for the goods purchase, international shipping fee, and necessary fees.
Article 3: Membership Registration and Application
A "Non-member" applies for membership by filling out personal information in the form provided by DUCKS KOREA and expressing agreement to these terms.
Membership applications must be made directly online by the applicant. If the applicant is a minor, they must obtain consent from their guardian before applying for membership.
DUCKS KOREA will register applicants as members unless they fall under any of the following:
a. The applicant has previously lost DUCKS KOREA membership.
b. The application contains false information.
c. The applicant is a minor who has not obtained guardian consent.
d. The applicant has previously failed to pay debts owed to the Company.
e. The applicant has interfered with DUCKS KOREA's operations or other members' use of the service.
Members must inform DUCKS KOREA of any changes in their registration details through member information modification or email.
Article 4: Membership Withdrawal / Loss of Membership
Members can request to withdraw from DUCKS KOREA at any time, and DUCKS KOREA will process the withdrawal immediately.
DUCKS KOREA can restrict or suspend membership if the member:
a. Provided false information during registration.
b. Fails to pay debts related to DUCKS KOREA services.
c. Engages in prohibited or unreasonable conduct according to laws or these terms.
d. Performs acts contrary to DUCKS KOREA's purpose, such as abusive language, defamation, or obstruction.
If the same conduct is repeated more than twice or not corrected within 14 days after membership restriction/suspension, DUCKS KOREA may terminate the membership.
If membership is terminated, DUCKS KOREA will notify the member, providing at least 15 days to explain before the termination.
Article 5: Protection of Member Personal Information
DUCKS KOREA must obtain members' consent when collecting personal information.
When obtaining consent, DUCKS KOREA must notify members in advance of:
a. The identity and contact details of the personal information manager.
b. The purpose and use of the information.
c. The third party receiving the information, the purpose, and the provided information.
d. Users' and legal representatives' rights and how to exercise them according to relevant laws.
Personal information provided by members cannot be used or provided to third parties beyond the stated purposes without consent, except in cases such as:
a. Necessary minimum information for delivery purposes.
b. Service contract fulfillment.
c. Billing and payment for services.
d. Statistics, research, or market survey in anonymized form.
Members can request to view or correct their personal information, and DUCKS KOREA must promptly take necessary actions. During correction, DUCKS KOREA will not use the concerned information.
Members can withdraw consent at any time, and DUCKS KOREA must promptly take necessary actions, including destroying collected information.
Withdrawal of registered personal information follows the 'Article 8 Membership Withdrawal Regulation.'
DUCKS KOREA must take necessary actions upon receiving requests for consent withdrawal, viewing, or correction of personal information from members.
Third parties who receive personal information from DUCKS KOREA must destroy it promptly after achieving the purpose, except as required by laws.
Article 6: Member Obligations
Members must not:
a. Register false information or use another member's information.
b. Damage information posted on DUCKS KOREA.
c. Send or post information other than specified by DUCKS KOREA.
d. Infringe on DUCKS KOREA's or third parties' intellectual property rights.
e. Damage the reputation of DUCKS KOREA or third parties, interfere with business, or post inappropriate content.
Members are liable for any damages resulting from violating these obligations.
Members must pay the international shipping fee within 30 days if they use DUCKS KOREA's logistics center address for purchases. If not paid, the goods will not be shipped.
DUCKS KOREA is not responsible for theft, damage, or loss of goods occurring after 30 days of notifying members for payment and may dispose of goods after 60 days to cover storage fees.
Members must register a shipping application form before the goods arrive at DUCKS KOREA's logistics center. Unregistered goods will be stored for up to one month.
Article 7: Service Interruption
DUCKS KOREA may temporarily suspend services due to maintenance, replacement, or breakdown of information and communication equipment, or communication disruption.
DUCKS KOREA may notify members and suspend services if it cannot provide services due to business transitions, mergers, or other reasons.
Article 8: Member Notification
DUCKS KOREA may notify members via the pre-agreed email address or message.
For unspecified members, DUCKS KOREA can substitute individual notifications by posting on the DUCKS KOREA board for at least one week. However, individual notifications will be provided for matters significantly affecting members' transactions.
Article 9: Service Application Changes / Cancellation
Service changes or cancellations are generally not possible after a purchase agency contract is concluded. However, DUCKS KOREA may allow cancellations or changes following the policies of overseas internet sites, and any related costs and fees must be borne by the member.
Members can change the delivery destination and method before the goods arrive at the local logistics center.
DUCKS KOREA may terminate contracts for prohibited items and notify members accordingly.
Contracts cannot be changed or canceled after international shipping has started.
DUCKS KOREA may change the specifications of goods or services provided in future contracts and notify members accordingly.
Article 10: Refunds and Additional Costs
DUCKS KOREA will refund costs for out-of-stock, returned, or refunded items in purchase agency transactions. Refunds for amounts already processed by overseas sites will be handled after receiving the refund from the seller.
If there is a price change in purchase agency transactions, the excess amount will be billed to the member, and any remaining amount will be refunded via bank transfer or credited upon the member's request.
Article 11: Returns and Exchanges, Damage, Loss
Members can return or exchange goods if:
a. The auction listing allows returns/exchanges or the seller accepts them.
b. The seller's terms allow returns/exchanges for delivery or purchase agency.
DUCKS KOREA must handle returns/exchanges as per the specified conditions, and members bear international shipping costs and fees.
For returns/exchanges due to personal preference or mistakes, members bear all costs and fees.
Members bear all costs for returns due to defective or wrong items in purchase agency.
For issues not caused by the seller, DUCKS KOREA, or the member, the member bears all return costs.
Members must handle claims for damages occurring during shipping directly with the relevant institutions.
DUCKS KOREA is not liable for damages during international/domestic shipping. Members must contact DUCKS KOREA for insurance inquiries.
DUCKS KOREA is not liable for incorrect deliveries by USPS without signatures.
DUCKS KOREA is not liable for delivery system errors causing losses.
DUCKS KOREA is not liable for non-staff signatures on deliveries from FedEx, UPS, or DHL.
Article 12: Goods Receipt, Shipping, Storage
Members must use safe payment methods for purchase agency transactions. DUCKS KOREA is liable for payment issues caused by its fault but not for issues from rejecting DUCKS KOREA's methods.
DUCKS KOREA is not liable for wrong or damaged items in delivery agency. Members bear all return/exchange costs.
DUCKS KOREA generally ships goods in their original packaging unless re-packaging is necessary, and is not liable for damage during re-packaging.
DUCKS KOREA will take necessary actions to ship goods within normal business hours or the next day if payment is made after hours.
DUCKS KOREA may extend shipping times due to requests, delays in approval, unavoidable reasons, or force majeure.
DUCKS KOREA may dispose of goods and charge storage/disposal fees if service fees are unpaid within specified times.
DUCKS KOREA's maximum storage period is 30 days, after which no responsibility is taken. Disposal fees and daily charges apply after 30 days, with goods discarded after 60 days.
DUCKS KOREA may repackage goods for safe, quick shipping without prior consent.
Article 13: Limits and Scope of Responsibility
DUCKS KOREA is liable for damages caused to members within the purchase cost and related expenses.
a. Incorrect size/color ordered by DUCKS KOREA.
b. Loss due to incorrect address provided by DUCKS KOREA.
DUCKS KOREA is not liable for inspecting goods or guaranteeing quantity, authenticity, or quality.
DUCKS KOREA is not liable for damages to stored goods exceeding the storage period due to unavoidable reasons.
DUCKS KOREA is not liable for legal issues arising from importing goods for resale.
DUCKS KOREA is not liable for customs rejections or disposals of restricted items.
DUCKS KOREA is not liable for unilateral cancellations or changes by the seller.
DUCKS KOREA is not liable for delays due to force majeure or seller issues.
DUCKS KOREA is not liable for issues arising from direct orders and payments by members.
Members must contact relevant institutions for damages during shipping.
DUCKS KOREA is not liable for accidents during shipping unless insured in advance.
Article 14: Service Application
Users can apply for services on DUCKS KOREA by providing the following or similar information:

Name of the overseas internet shopping site where the member ordered and paid directly.
Price and details of the ordered items.
Accurate English name of the orderer and recipient.
Domestic delivery address and recipient's name/contact number.

Exact individual item addresses (URLs) for items to be ordered/paid for.
Necessary options such as quantity, color, size, etc.
Domestic delivery address and recipient's name/contact number.
Payer's name for the estimated transaction amount.

Accurate English name of the orderer and recipient.
Domestic delivery address and recipient's name/contact number.
Article 15: Right of Withdrawal
Users who have entered into a contract for the purchase of goods with the Company can withdraw their offer within seven days of receiving confirmation. Returns and exchanges are not allowed if:
The goods are damaged or lost due to the user's fault.
The value of the goods has significantly decreased due to the user's use or partial consumption.
The value of the goods has significantly decreased over time, making resale difficult.
The goods' packaging is damaged, allowing replication of the same performance goods.
DUCKS KOREA may refuse to accept service applications if:
a. The application contains false, missing, or incorrect information.
b. A minor attempts to purchase prohibited items under the Youth Protection Act.
c. Accepting the application poses technical or characteristic issues for DUCKS KOREA.
The contract is considered concluded when DUCKS KOREA's acceptance reaches the user by any customary means, such as order receipt comments, messages, pre-purchase, oral agreement, or other conventional forms. Delivery agency contracts are concluded upon application receipt, and purchase agency contracts are concluded upon payment.
Article 17: Dispute Resolution
DUCKS KOREA establishes and operates a damage compensation processing body to reflect and compensate for users' legitimate opinions and complaints.
DUCKS KOREA prioritizes handling complaints and opinions submitted by users.
Article 18: Handling of Restricted Goods
DUCKS KOREA may return goods to the original sender or handle goods as appropriate if:
a. The goods are prohibited items such as animals, precious metals, currency, pharmaceuticals, weapons, body parts, pornography, precision metals, stones, refrigerated/frozen items, or explosives.
b. The goods cannot be imported/exported or transported by sea/air.
c. The invoice is poorly filled, the packaging is inadequate, or DUCKS KOREA deems the goods inappropriate for service.
d. The goods are restricted by relevant laws for import/export.
e. Goods are repeatedly or divided for import to apply duty-free benefits or forced to be divided for duty-free application.
DUCKS KOREA may refuse or provide services through a separate contract for goods deemed unserviceable for business reasons.
The member bears all costs for transactions canceled due to restricted goods.
